Terms of Service

1. Acceptance

By accessing or using any website, application, or online service operated by BizNuma under biznuma.com and its subdomains (collectively, the "Service" or "Platform"; "we", "us"), you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms govern your use of the Service. How we collect and handle personal data is described separately in our Privacy Policy.

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use after changes are posted constitutes acceptance.

2. Our Products

BizNuma provides software products and services for Indian businesses through websites and applications under biznuma.com and its subdomains. Available features may vary by product. Unless stated otherwise for a specific product, the following describes our WhatsApp CRM platform, which enables you to:

  • Manage customer conversations via a shared WhatsApp team inbox
  • Capture and track leads from IndiaMART, JustDial, and other sources
  • Send automated replies, follow-up sequences, and broadcast messages
  • Create and send quotations and estimates to customers
  • Share your product catalog on WhatsApp
  • Collect payments via Razorpay payment links sent in chat
  • View sales pipeline and team performance reports

BizNuma uses Meta's Official WhatsApp Business API. You must comply with WhatsApp's Business Policy and Commerce Policy when using BizNuma.

3. Eligibility & Account

To use BizNuma you must:

  • Be at least 18 years of age
  • Represent a legitimate business or operate as a sole proprietor
  • Provide accurate registration information

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@biznuma.com if you suspect unauthorised access.

4. Your Responsibilities

As a user of BizNuma, you agree that you are responsible for:

  • The content of messages, templates, and materials you send through the platform
  • Obtaining appropriate consent or having another lawful basis before messaging your customers on WhatsApp
  • Ensuring your use of customer and lead data complies with applicable law
  • Informing your own customers about how you handle their data, where required
  • Managing access for team members and others you authorise to use your account

5. Acceptable Use

You agree not to:

  • Send spam, unsolicited messages, or bulk messages to people who have not opted in
  • Send messages that violate WhatsApp's policies, including promotional content outside approved templates
  • Use BizNuma to harass, deceive, or defraud customers
  • Attempt to reverse-engineer, hack, or disrupt the platform
  • Share your account credentials with individuals outside your organisation without appropriate controls
  • Use BizNuma for any unlawful purpose under Indian or applicable law

Violation of these terms may result in suspension or termination of your account.

6. Plans, Billing & Cancellation

The following applies to our WhatsApp CRM product unless a different product page or agreement states otherwise. BizNuma offers a Free plan and paid plans (Starter at ₹999/month, Pro at ₹2,999/month, Growth at ₹5,999/month). Prices shown are per month within a subscription term. Paid plans are available on 3-, 6-, or 12-month subscription terms only. All fees are exclusive of applicable GST (18%).

Subscription fees are payable in advance for the full term you select. You may cancel renewal of a paid plan before your next billing cycle; access continues until the end of the current paid term. We generally do not offer refunds for unused portions of an active subscription term, except where required by law.

We reserve the right to change plan pricing or features with reasonable notice to registered users. Current plan details are published on our pricing page.

7. WhatsApp API Compliance

Where you use a BizNuma product built on Meta's Official WhatsApp Business API (such as our WhatsApp CRM), you acknowledge that:

  • You are solely responsible for the content of messages you send through the platform
  • You must obtain proper consent from your customers before messaging them on WhatsApp
  • Violation of Meta's WhatsApp policies may result in your number being restricted or suspended by Meta
  • BizNuma is not liable for any WhatsApp number restrictions caused by your misuse or non-compliance

8. Third-Party Services & Availability

BizNuma integrates with third-party services — including Meta and the WhatsApp Business API, IndiaMART, Razorpay, JustDial, and others — to deliver certain features. These services are operated independently and are subject to their own terms, policies, and availability.

From time to time, third-party platforms may experience outages, maintenance, API changes, rate limits, or other interruptions beyond our control. When that happens, related BizNuma features may be delayed, limited, or temporarily unavailable.

We will make reasonable efforts to maintain the platform, but we do not guarantee uninterrupted access to any feature that depends on a third-party service. BizNuma is not liable for disruption, inaccuracy, or discontinuation of any third-party service.

9. Intellectual Property

BizNuma and its content, features, and functionality are owned by BizNuma and protected under applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the platform without our written permission.

You retain ownership of all data, contacts, and content you upload or create in BizNuma. By using the platform, you grant BizNuma a limited, non-exclusive licence to store and process your data solely to provide the Service, as further described in our Privacy Policy.

10. Disclaimer of Warranties

BizNuma is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of security vulnerabilities.

11. Limitation of Liability

To the fullest extent permitted by applicable law, BizNuma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the platform. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required to do so by law.

On termination, your access to the platform ceases. Handling of your data after termination is described in our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
